TO THE FULLEST EXTENT PERMITTED BY LAW, JHA Safety, LLC d/b/a Optimum Mechanical Services SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $100 IF NO PAYMENTS WERE MADE).

You agree to indemnify and hold harmless JHA Safety, LLC d/b/a Optimum Mechanical Services, its affiliates, and their respective officers, employees, and agents from any claims, damages, or expenses (including attorneys’ fees) arising from:

Your violation of these Terms.

Your violation of any third-party rights.

8. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Jefferson County, Texas. You consent to the personal jurisdiction of such courts.

9. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on the Website with a revised “Last Updated” date. Your continued use of the Services after changes constitutes acceptance of the new Terms.

10. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Services.

Severability: If any provision is found invalid, the remainder remains in effect.

No Waiver: Our failure to enforce any right does not constitute a waiver.
